The Kansas Delta 8 was settled until 2 December 2021, Attorney General of Kansas, Derek Schmidt gave a controversial statement saying that Delta 8 is illegal. He stated that Delta 8 THC is illegal because it falls under the controlled substance of Schedule 1. He further said that any Delta 8 THC Kansas product that contains more than 0.3% THC (Delta 8+ Delta 9) would be illegal. 

After this, the police started raiding and seizing the Delta 8 Kansas City shops. Many retailers faced severe losses and one retailer in Topeka had to turn over $120,000 worth of Delta 8 products. This raged the Delta 8 retailers and the store owner Murray Dines filed a lawsuit in June 2022, against the state officials, demanding compensation and arguing that Delta 8 is legal.

Around the same time, the District Attorney of Douglas County supported the statement of Derek Schmidt and sent letters to various Delta 8 manufacturers and retailers to stop manufacturing and selling Delta 8 products in Kansas. They even asked the authorities to either legalize or ban Delta 8, but at least make things clear. 

All in all, for now, Delta 8 is legal in Kansas & there is a major need for proper and clear laws regarding Delta 8.
